    Wellsfargo ignored my letter contesting the pre-foreclosure where I requested assistances bringing my loan current. Then they moved me into active foreclosure a month later. I have spoke with over 15 reps, various home specialist, and foreclosure agent. I keep getting the run around and no one has concrete answers for me.

    wells faro is the reason I am in forclosure they had me in a modification for over three year why they dual tracked me. they mislead and bully me it is not even my debt.they put it into estate .when the mortage should have been put in my name.did you know that john stump makes 49 billion a year .this is how he makes that kind of money by comitting fraud bank and title fraud on the american home owners. john stump should be put in jail ,he is a bully to the poor,but in fact it is the poor that has made john stumps 49 billion a year.

    I also attempted to get a loan modification, starting in January of 2012. I was blatantly lied to in my very first telephone contact with a Wells Fargo sociopath, which was the start of a two and a half year long never-ending series of lies and corrupt manipulations on the part of these predators. I also have very well documented notes concerning my interactions with these scumbags : BUT IT DOES NOT MATTER !!!!!! They are true sociopaths and they do not care that they are destroying peoples lives. I also sought help from the Fannie Mae Center in Philadelphia. They are either just as corrupt as Wells Fargo and possibly in a conspiracy with them, or they are staffed by incredibly incompetent morons. I also filed a complaint with the national Consumer Financial Complaint Board; which tells you AFTER YOU FILE that they do not in any way intervene or advocate for you, but they tell you to be proud that you have taken a step to bring these corrupt practices to their attention. I have spoken with five attorneys, all of whom stated that Wells Fargo and the other major mortgage corporations are totally corrupt and basically untouchable. My current Foreclosure Defense attorney estimates that my home will be on the sheriffs auction calendar in September, 2014.

    After complying and fulfilling every request from Wells Fargo Home Mortgage and its representatives, I was denied a loan modification & foreclosed. I was naïve and uniformed of the repetitive bad faith and misconduct of Wells Fargo Home Mortgage.

    I am appalled that these people have not been prosecuted. The following is a timeline of my life over the past four years.


    • On or about July 2008;

    I contacted Wells Fargo via telephone & explained that I was beginning to experience some financial hardship. I asked about the possibility of lowering the interest rate on loan # 0171309776. I was blatantly turned down & was told nothing about this loan could be adjusted unless I was at least 90 days behind on the payments. I was told that if I wanted a loan modification, I should stop making the payments.

    • On or about November 2008;

    After careful thought and consideration, I decided to discontinue making the timely monthly payments on this loan, so that I could get a loan modification. (Against the ethics in which I was raised, I followed the instruction, of the Wells Fargo employee given in July 2008.)

    • December 01, 2008;

    I contacted Wells Fargo via telephone and “Gary” said “to modify this loan, you need to speak to someone in the default department.” He then gave me telephone number: 800-416-1472.

    I immediately called the number & was placed on terminal hold (for over 18 minutes) & he never returned to the phone.

    • On December 02, 2008;

    I called the default department again and “Eileen” said that the interest rate for loan number 0171309776 would NOT be adjusted.

    • On or about January 26, 2009;

    I received a letter from Wells Fargo Return Mail Operations stating that my inquiry concerning my mortgage loan had been received. It reads: In order to process your request for MODIFICATION, the following information is needed. “XX” indicates the documents required for each specific borrower. (B1=Borrower, B2=Co-Borrower)

    (None of the documentation listed was requested or indicated with”XX”)

    • On or about March 18, 2009;

    I received a letter from Glen Putnam, Loan Servicing Specialist at Wells Fargo Return Mail Operations stating “As you requested, this letter is to inform you the request for Loan Modification has been cancelled, and we have closed your file.” (I have never asked for my Loan Modification to be cancelled or the file to be closed!)

    • On or about March 23, 2009;

    I received a letter from Wells Fargo Return Mail Operations stating “From this day forward, we will only accept the total amount to satisfy all outstanding payments due, plus all applicable fees. Any monies received that are less than the total amount due will be returned.”

    • On or about March 23, 2009;

    I received a letter stating that my loan “has been referred to an attorney with instructions to begin foreclosure proceedings. You are hereby notified that, due to the default under the terms of the mortgage or deed of trust, the entire balance is due and payable.”

    • March 30, 2009;

    I contacted Wells Fargo via telephone at 800-848-9862 and spoke to “Dean”. He instructed me to write a hardship letter, including my income and a list of my expenses. He said to fax it to Wells Fargo Loss Mitigation at 866-590-8910. He instructed me to call 800-416-1472 a few days after faxing to make sure it was received and “scanned in”.

    • On April 02, 2009;

    At 1:45 PM, I faxed a hardship letter, including my income and list of my expenses to 866-590-8910.


    • On or about April 03, 2009;

    I received a letter from Wells Fargo Home Mortgage thanking me for my “interest in our Borrower Counseling Program”. Also stated in that letter ……“By expressing your interest to work with us, you have taken the first step in resolving your current situation. Once we receive the documents requested from you and begin processing your application, some of the options that may be available to you include:

    • Repayment Plan

    • Loan Modification

    • Short Sale

      Deed in Lieu of Foreclosure

      A Financial Worksheet form accompanied that letter.

      • April 15, 2009;

      I completed the Financial Worksheet (as requested) and faxed it with my recent pay stubs to 866-670-3698, 866-359-9585, and 866-359-7363. (All requested information was sent)

      • April 27, 2009;

      I contacted Well Fargo via telephone at 800-416-1472 to inquire whether my fax dated April 15, 2009 had been received. After numerous attempts to reach someone with an answer, I was informed that I had neglected to sign and date the bottom of the Financial Worksheet page. (There is no space provided for a signature, nor instruction to sign)

      I immediately signed, dated and re-faxed the Financial Worksheet and paycheck copies to 866-670-3698.

      • On or about April 30, 2009;

      I contacted Wells Fargo via telephone at 800-416-1472 and was informed (by a female employee)that I was being placed on a “trial program” in which the interest rate has been reduced to 4.75%, changed from an interest only loan to a principal & interest loan, and that the new principal amount was $241,000.

      (The original loan amount was $224,000)

      • On or about May 04, 2009;

      I received a package via UPS, containing numerous document s about a “TRIAL PERIOD” stating that I must sign these documents and return them right away.

      There was no written explanation of HOW Wells Fargo arrived at the payment amount, WHAT the interest rate would be or WHERE these payments would be applied. The documents stated that I must send in “trial period” payments of $1,215.80 and that I MUST accept these undefined terms no later than May 30, 2009.

      • May 28, 2009;

      I contacted Wells Fargo via telephone at 866-662-4866 and was informed (by a female employee) that the interest rate is now 2.5%. I expressed my concerns regarding the “trial period” payments being non-specific and vague at best.

      • May 28, 2009;

      I mailed a letter to Wells Fargo designated to the attention of Sabrina Coleman / Ben Windust, expressing my concerns regarding the “trial period payments, the inconsistencies in the information I have been receiving from Wells Fargo Home Mortgage and Wells Fargo Loss Mitigation and a request to lower the interest rate on loan #0171309776. Included in that correspondence: Information on Congress passing ANTI-FORECLOSURE bill, a print out of my qualifying for HOME AFFORDABLE MODIFICATION from the http://makinghomeaffordable.gov, a summary of HOPE for Homeowners S.
      ( Provisions, and May 20, 2009 changes to HOPE for Homeowners Program from http://portal.hud.gov

      • June 04, 2009;

      I was contacted via telephone by “Kim” at Wells Fargo Loss Mitigation. She asked me to call (800) 416-1472 extension #3670 and ask for my “negotiator”. I immediately called Wells Fargo and spoke to someone named




    “Sega”. She informed me that the documents were received on June 1. I was then transferred to someone named “Jeremy”. I was again transferred to a woman that told me my interest rate on loan #0171309766 is as follows:

    Years 1-5 years=2.5%

    Year 6=3.5%

    Year 7=4.5%

    Years 8-28=4.75%

    I was then put on hold for approximately 6 minutes & transferred to a gentleman named “Varicio”.

    This man was very, very rude and would not answer any of my questions. He said that “…..this is no longer an open case, because you did not sign the paperwork” You need to start over”. I asked “Varacio” to please send me the terms, interest rate, principal amount and payment amount(s) in writing. He simply said “NO”. He stated that the documents were not signed, so everything is null & void. He instructed me to apply again & resend a hardship letter to 866-670-3698. (I signed all documents requiring a signature and all requested information was sent)

    • June 07, 2009

    At 2 PM, I faxed another hardship letter to Wells Fargo Loss Mitigation department at 866-590-8910, 866-670-3698, 866-359-9585, and 866-359-7363. Included in the fax communication: Letter dated May 28, 2009 to Sabrina Coleman, Financial Statement, and an article from the internet titled:

    “Freddie Mac Says Typical Foreclosure Cost 60, 0000 Dollars”

    • June 09, 2009;

    I contacted Wells Fargo Loss Mitigation via telephone at 800-416-1472 and spoke with “Lori”. She informed me that this was an active foreclosure with a sale date of July 22, 2009. She also stated that this is an active loss mitigation case. Lori updated my expenses and instructed me to wait for someone at Wells Fargo to contact me.

    • On or about June 10, 2009;

    I received a letter from Wells Fargo Return Mail Operations stating that “your request for loan modification has been denied for the following reason(s):

    As you have not sent the information we have requested from you”.

    • June 18, 2009 I contacted Wells Fargo via telephone at 800-551-9808 and spoke with “Tia”. She informed me that this “has not yet been assigned to anyone in loss mitigation”. And “Wait for someone from Wells Fargo to contact you”.

    • On or about June 21;

    I received a letter from Wells Fargo Return Mail Operations (dated June 18, 2009).

    It is the exact same letter requesting financial information that I received dated January 15, 2009.

    (All requested information was sent)

    • July 02, 2009;

    I contacted Wells Fargo Loss Mitigation via telephone at 800-416-1472 and spoke with “Kalia” in the interest only department. She informed me that my home had been set up for a “short sale”. I explained to her that I have full intention of staying in my home and have no interest in a “short-sale”. She said that she would remove the “short-sale” status immediately.

    • July 06, 2009;

    I contacted Wells Fargo Loss Mitigation via telephone at 800-416-1472 and spoke with “Dina”. I was informed that the “short-sale” status had been removed & that I would be receiving a package in the mail with full modification terms within 7 to 10 days.

    • July 13, 2009;

    I contacted Wells Fargo Loss Mitigation via telephone at 800-416-1472 and spoke with “Jessica”. I was informed that I am under review for a modification & someone would contact me. She said the auction date of July 22 has been postponed.


    • On or about July 17, 2009;

    I received a letter from Wells Fargo Return Mail Operations stating:

    “We’re reviewing your request”

    ”We’ll keep you posted”

    “Next Steps” “Right now, you don’t have to do anything”

    • On or about August 05, 2009

    I received a letter from Wells Fargo Return Mail Operations stating:

    “We’re reviewing your request”

    • On or about September 11, 2009

    I received a letter from Wells Fargo Home Mortgage stating:

    “We can only process a loan modification with input from you.

    We have been unable to reach you to discuss your situation

    For that reason, you have not been approved for a mortgage loan modification”

    • September 13, 2009;

    At 9 AM, I faxed yet another hardship letter to Wells Fargo Loss Mitigation department at 866-590-8910, 866-670-3698, 866-359-9585, and 866-359-7363. Included in the fax communication: Letter dated May 28, 2009 to Sabrina Coleman, Financial Statement, and an article from the internet stating “Freddie Mac Says Typical Foreclosure Cost 60, 0000 Dollars, and a fact sheet from www.hud.gov titled “FHA To Provide Additional Mortgage Assistance To Struggling Homeowners”

    • September 16, 2009;

    I contacted Wells Fargo Loss Mitigation via telephone at 800-416-1472 and was informed that I had neglected to sign the most recent documents faxed. I immediately signed & re-faxed all documents to Wells Fargo Loss Mitigation department at 866-590-8910, 866-670-3698, 866-359-9585, 866-359-7363.

    • On or about September 18, 2009;

    I received a letter from Wells Fargo Return Mail Operations (dated September 15, 2009) stating that my inquiry concerning my mortgage loan had been received. It reads: In order to process your request for MODIFICATION, the following information is needed. “XX” indicates the documents required for each specific borrower. (B1=Borrower, B2=Co-Borrower) This document had XX indicating a request for Proof of Income (paystub, SSI, child support) from B1. (All requested information was sent)

    • On or about September 28, 2009;

    I received a letter from Wells Fargo Home Mortgage (dated September 25, 2009) stating:

    “Unfortunately, after carefully reviewing the information you’ve provided, we are unable to adjust the terms of your mortgage.” It also reads: “This decision was made because you did not provide us with all of the information needed within the time frame required per your trial modification period workout plan. For that reason, you have not been approved for a mortgage loan modification”.

    • September 29, 2009;

    I contacted Wells Fargo Loss Mitigation via telephone at 800-416-1472 and spoke with Dee Dee. I was informed that these two most recent documents must have “crossed in the mail” and to “disregard” the notice dated September 11, 2009, stating that my loan cannot be modified.


    • On or about October 05, 2009;

    I received a letter from Wells Fargo Return Mail Operations containing information about a short-sale. I contacted Wells Fargo Loss Mitigation via telephone at 800-416-1472 and was instructed to contact the Prime Interest Loss Mitigation department at 866-662-4866. I was informed that I need to submit a new loan packet modification. This information includes: hardship letter, financial worksheet, pay stubs and must include the loan number on the top of each page. I was instructed to fax this information to 866-670-3698. (All requested information was sent)

    • October 22, 2009;

    I faxed the requested hardship letter, & Financial Worksheet, my letter dated May 28, 2009 to Sabrina Coleman, and various other pages to Wells Fargo Loss Mitigation department at 866-670-3698.

    • November 06, 2009;

    At 10:30 AM, I contacted Wells Fargo Loss Mitigation via telephone at 800-416-1472. I was informed that the info sent via fax on October 22, 2009 had been received and would be sent to a negotiator. She said the sale date would be postponed. I asked when the current sale date is on my home and after some brief searching, the Wells Fargo employee informed me that today was the sale date! She insisted that I call 866-798-0213 right away and tell them that Wells Fargo had received the information from me on October 23 & to stop the sale.

    I called as instructed and the gentleman informed me that I am not authorized to call them; Wells Fargo would need to contact them directly.

    At 11:15 AM, I called Wells Fargo Loss Mitigation back at 800-416-1472. I spoke with numerous individuals and was finally connected with “Henry”. He said he sent over info to stop the sale of my home during the course of our telephone conversation. He suggested I call back in an hour or two and check the status.

    At 2:05 PM, I contacted Wells Fargo Loss Mitigation at 800-416-1472 and spoke with “Celeste”. She had no information & sent me to speak with “Paul”. Paul had no information.

    I contacted Wells Fargo Loss Mitigation via telephone at 800-416-1472 and spoke with “Ed”. He informed me that my home had been purchased by Wells Fargo. Ed was as rude as Varacio (from June 04) and actually said to me “you better start packing your things and look for a place to live”

    • November 18, 2009;

    I contacted Wells Fargo @ 800-416-1472 & spoke with “Mia”. I asked about the status of my complaint. She said to wait for communication. Wells Fargo is in the process of researching whether there was an error on the part of Wells Fargo in selling my home. If so, they will rescind the sale of my home. She went on to say that if the sale is rescinded, I will have 6 months to either refinance, pay off the loan, or see what options Wells Fargo has to offer me. She said that Wells Fargo purchased my home for $137,900. Mia said for more information; I can call First American Loan Star @ 866-798-0213. I called & spoke to “Myrna”. She informed me that my file was closed with their company. Wells Fargo will hire a 3rd party (Realtor) & they’ll serve me with an eviction notice.

    I contacted “Elizabeth” at Wells Fargo 800-416-1472. She informed me that my complaint was received on November 10 and a rescission review began on November 12. She said the letter from Titanium was sent in error because it was sent AFTER the sale date. She said my complaint is being reviewed & to call back within 30 days.

    I contacted “Heidi” at Freddie Mac & she said the property went to auction so I need to speak to “Homesteps”@ 800-972-7555. I called that number & spoke with “Jennifer”. I explained the fact that my home should not have been sold, I was never informed & I have never been given any modification opportunity. She said that she sent a


    request to corporate for an eviction representative to contact me. She informed me that my customer number (CSTS) is 36123. She said if someone from Freddie Mac doesn’t contact me within 24 hours, I should call them on Wednesday (11/25) in the morning. She gave me a fax number for Freddie Mac.

    I contacted Homesteps @ 800-972-7555 & spoke to “Jennifer” again. She informed me that she had put a note on the desk of her supervisor, asking that I be contacted immediately. She informed me that the supervisor would be calling me on Friday (November 27, 2009) to discuss stopping the eviction process.

    I contacted Malcolm Cisneros @ 949-252-9400 & spoke to “Jaclyn”. She put “Abby” on the telephone. I was informed that I have 20 days after the foreclosure to work something out with Titanium Solutions. Abby went on to say that the property is “on hold” until I can work something out with Titanium Solutions. She said the letter from her company was not supposed to be mailed until November 30, 2009. She said Titanium needs to contact Cisneros to postpone eviction. I was instructed to fax any information from Titanium to Cisneros at 949-252-1257 & Cisneros will forward to Freddie Mac.

    I contacted Titanium Solutions @ 866-697-9079 and spoke to “Luz Cubano”. I inquired about the letter stating “One of our consultants will be contacting you soon….”. She informed me that on November 14 @ 5 PM and again on November 15 @ 4PM, someone from Titanium came to my home & was told that I would be out of town for a few weeks. (The facts of the matter are as follows: I was out of town when an older man came to my home on November 14, pulled his Harley Davidson motorcycle into my driveway & rang the doorbell. He didn’t leave his name, a company name or any contact information.)


    “Luz Cubano” informed me that Freddie Mac is trying to do a “loan reinstatement”. I inquired about the statement in the letter I received from Titanium “…neither Titanium nor our consultant has any authority to modify your loan or contractually bind Freddie Mac. You will have to do that directly with Freddie Mac.”

    She told me that Titanium has no authority to modify a loan. They gather information and forward it to Freddie Mac. She said that I must immediately fax a hardship letter, pay stubs for the last 30 days, to a completed financial form. I was informed that Freddie Mac will decide if I qualify for a loan reinstatement. (The same terms as original loan) “Luz Cubano” seems a bit frustrated & put “John Lee” on the telephone. He barked at me a few times & I mentioned that he sounded like a collector. He said “Thank you! I AM a collector!” Mr. “Lee” said to fax the aforementioned information to 866-697-9080. Once I was able to calm him somewhat, he informed me that many banks are aggressively buying mortgages from Freddie Mac & those banks are able to modify loans.

    I contacted Homesteps @ 800-972-7555 and spoke to “Eddie” (female). She put the supervisor “Melissa” on the telephone. As I began explaining the history & problems related to this case, a gentleman by the name of “Bill” called me on my cell phone. He informed me that he was in an “elevated” position at Freddie Mac. Melissa said that was the guy I needed to speak with, so our call was terminated.

    I spoke with “Bill” for an extended period of time. He listened and said he has requested that the foreclosure be reversed so I am afforded a loan modification thru Wells Fargo & the HAMP (Home Affordable Modification


    Program). He requested status from the REO department (Real Estate Owned). He said he will be in contact with me on December 09, 2009 @9 AM (if not sooner) with a status update. “Bill” said that in the meantime, I should contact Wells Fargo & request HAMP, 2% interest, for 40 years and the payment needs to be less than 31% of my income. He said I will need to make the adjusted payment for 3 months before a permanent modification begins. He suggested I research the Arizona foreclosure & eviction laws. He also mentioned: “creative solutions”, “alternative workout program”, and a “regular loan modification”.

    I contacted Wells Fargo @ 800-416-1472 and spoke to “Latoya”. I inquired about the status of my complaint. She said there are no new updates, it is under review. She said to call back next week.

    I found a “NOTICE TO VACATE THE PREMISES” sticking through the gap of my front door from Malcolm Cisneros. I attempted to contact then at 949-252-9400. I dialed the number six consecutive times & got a recording “All circuits are busy”.

    At 4 PM I finally got through & spoke with a young woman that kept putting me on hold & returning only to inform me that no one was available to help me. I was placed on hold again & after approximately 12 minutes, a woman named “Loraina” came on the telephone. She listened as I explained the situation & she said that it appears I am speaking with all of the right people (Freddie Mac & Wells Fargo). Loraina said Freddie Mac will need to communicate with Malcolm Cisneros & Titanium to stop the eviction process. She is in the “cash for keys” department & cannot help me.

    I contacted Wells Fargo Written response team at 877-491-0707 Extension 65064 in regards to her letter dated November 30, 2009. She said the “customer satisfaction department” reviewed my complaint & they will not rescind the sale of my home. She said if I am dealing with Freddie Mac, then I should continue to work with them towards a resolution. She said there is nothing that she can do. She advised me that Wells Fargo now owns my home.     I went to the post office in response to notification of a missed Certified Mail Delivery on December 04, 2009. I received a “NOTICE TO VACATE THE PREMISES” from AAA Landlord Services for Malcolm Cisneros Law Firm. This is the exact same verbiage as the letter pushed though the gap in my front door on December 02, 2009.

    • On or about December 11, 2009;

    I received another package containing HAMP documentation.

    • December 17, 2009;

    After a lengthy (tape recorded) telephone conversation with Jay Cockerham from WFHM, I completed all required HAMP documentation, signed all required signatures and mailed everything in the envelope provided.

    • January 01, 2010;

    I began making monthly Trial Period payments in the amount of $705.77 payable to Wells Fargo Home Mortgage. These payments were made directly at a local Wells Fargo branch office.

    • March 04, 2010;

    A Notice of Rescission of Trustee’s Sale And Trustee’s Deed Upon Sale was filed with First American Title Insurance Company along with a Cancellation of Trustee’s Sale.

    • Throughout June and July 2010;

    I had been receiving weekly telephone calls from Michael Burkhardt at WFHM. Each call consisted of requests for additional information to be sent to WFHM. The additional information being requested included: Hardship letters,
    bank statements, income statements, monthly bill statements, etc. Many of the requests from Mr. Burkhardt were for documentation previously sent to Mr. Burkhardt. Some documentation was sent more than five times. Mr. Burkhardt led me to believe his inquiries and requests were aimed at making the Trial Period payments I had been making (under the HAMP) my permanent modification payments.


    • On or about August 01, 2010;

    After making a total of eight Trial Period payments, I was informed at a Wells Fargo branch office that they could not accept the September Trial Period payment. Apparently, I was inexplicably removed from the review process.

    WFHM claims they did not receive the required information.

    • August 17, 2010 @ 12:04 PM; I received a call from Michael Burkhardt at WFHM and was informed that I didn’t qualify for the loan modification. Due to my growing skepticism of WFHM and its employee’s integrity, I tape recorded the conversation. Mr. Burkhardt confirmed my suspicions and completely contradicted the conversation (on December 17, 2009) between myself and Jay Cockerham.

    I called WFHM for an update. “Janice” said it is in active foreclosure / no current sale date / active in loss mitigation for a workout plan. She said as of September 01, they have my income, financial worksheet, and hardship letter. I told her that I had just received another financial worksheet, dated August 30 & I’ll send it in.

    • September 08, 2010; I called “Andy” at WFHM & he said to send in n the new financial worksheet. He also said that he was reading the August 17 transcript and will call me back.

    • September 17, 2010;

    I called WFHM for a status update. “Josh” informed me that it is in active foreclosure / no sale date / active review for a workout plan.

    • September 29, 2010;

    I called WFHM for a status update. “Jamesha” informed me that it is in active foreclosure / no sale date / active review for a workout plan. She wanted proof of child support as income.

    • September 30, 2010:

    I received a voicemail message from Lisa @ WFHM. I called the number she gave & spoke to “Sandy”. Sandy said that Lisa is the person that will be taking care of my documents for my loan modification. She expressed that if Lisa needs any additional information, she will call me.

    • October 05, 2010 I received a call from Shelly at WFHM. She expressed that she was calling on behalf on “Lisa”. She asked me to send in copies of my bank statements from July, August, and September. She asked “How can two people eat on $250 a month?” I told her to have “Lisa” call me tomorrow.

    • November 22, 2010; Lisa returned my call and said that she had heard back from the investor (Freddie Mac). She asked if I could make a payment of $9,957.06 as a “contribution” to reduce the past due amount owed. She said there is no current auction date and that she was trying to get me qualified for 5.25% & a payment of $1,400+.


    • December 08, 2010; Lisa called and said that Freddie mac’s most recent offer is a “Special Forbearance”. She explained that I needed to make three monthly payments of $1,437.58 so that I can save money and make the “contribution” of $9,957.06 toward delinquent interest. She said she’d send it in writing.

    • December 09, 2010; A Notice of Trustee Deed Upon Sale was recorded with the Maricopa County Recorder.

    • December 13, 2010; I received a message on my home phone number but could not understand the return telephone number given. I called 800-416-1472 and spoke to Katherine. She explained that this was active in loss mitigation / active in foreclosure / no current sale date.

    • December 14, 2010; someone from WFHM left a message on my home phone number & asked me to call 866-644-1565.

    I called. That number is a fax machine.

    • December 21, 2010; I called HAMP at 877-279-1647 and spoke to Kenton. I expressed my concerns with the run-around by WFHM and he suggested I fax information to the WFHM Written Correspondence Team. I faxed my concerns that day.

    • December 21, 2010; I called Lisa at WFHM & left a voicemail message.

    • December 21, 2010; I called the FBI office to inquire about the fax I had sent them on October 27, 2010. I was the duty agent would check on it & call me back.

    • December 21, 2010; I faxed a letter titled Something Stinks to the Arizona Attorney general along with a complaint and transcripts.

    • December 22, 2010 @ 9:39 AM; I called First American Title Insurance Company. Karen informed me that the WFHM Loss Mitigation hold had been removed.

    • December 22, 2010; Orlando from WFHM called and asked all of the same questions. I asked him to have Lisa Cessop call me.

I told him to postpone the sale date, pending the outcome of my complaint. He said he sent a message to the foreclosure liaison explaining the circumstances & that I asked for a postponement.

    He put me on hold, so he could check with loss mitigation. After approximately 9 minutes on hold, Dujuan returned and said that I should fax those documents to 866-359-7361.

    • March 11, 2011 @ 7:20 AM; I called WFHM and spoke to Rosanna. She said this was in active foreclose and sale date is March 14, 2011. She put me on hold, while she attempted to contact their attorneys. She came back & informed me that the attorney’s offices were closed. She said they open at 8 am Pacific time.

I explained to him that WFHM has been lying to me throughout this entire process & that I have filed complaints with the Arizona Attorney general and the Office of the Comptroller of the Currency. Osvaldo gave me inquiry ID # 56434. He said he is letting them know about the complaints and asking them to contact Malcolm Cisneros to put a hold on the eviction. He asked the eviction specialist to contact me.


    • March 22, 2011; I called Sylvia at Freddie mac & she said she cannot put a hold on anything unless she receives something from WFHM or the lender.

    • May 04, 2011; I received a call from Sylvia at Freddie Mac, but I was busy and couldn’t take the call. I asked her if it was okay to call her back in about 20 minutes and she said that would be fine. I called back in 19 minutes and left her a voicemail message. She returned the call timely and informed me that she had contacted the attorney this morning & told them to stop the eviction process. She said the file has been on hold since April 04, 2011. She also expressed that Freddie mac will not tell WFHM that they did something wrong. She said WFHM is reviewing my complaint and they will decide whether to rescind the foreclosure or proceed with the eviction. She explained that Freddie Mac’s contact with WFHM is to simply inquire whether or not the complaint has been resolved.

    • May 04, 2011; I called WFHM office of the president and spoke to Kerry Johnson. She was actually able to get Jason Mertes (who I had been trying to contact since early April). Jason Mertes said the only reason he called me on April 13, 2011, was to inform me that his response to the complaint filed with the Arizona Attorney General was in the mail.

    I received a call from Sylvia at Freddie Mac. She expressed that her and her supervisor reviewed the letters that I had sent. She said that since Freddie mac had not heard from WFHM, Freddie mac will not be moving forward/the eviction process. She said the April 05 Attorney General responses from WFHM explain the reason for them not modifying my loan. I explained to her that it was all lies. She didn’t seem to care.

    I received a call from Nathan Anderson at WFHM office of the president executive complaints. He said he received my email & the file sent to the I.F.R. cannot be pulled. He said the file must go through the I.F.R. process.

    I sent an email to WFHM the current value of my home and review of the documentation originally sent to the Independent Foreclosure Review.

    I sent an email to WFHM regarding coincidences between my case file & online information describing mishandling of HAMP and I.F.R. settlement. This communication also inquired about the review of documentation sent to the I.F.R.

    • January 23, 2013; I called Nathan Anderson at WFHM office of the president. He revealed that the file he is reviewing is not the file I sent to the Independent Foreclosure Review.

    • January 23, 2013; I received a voicemail message on my cell phone from Adam Horndig at WFHM office of the president. He identified himself as being the “team leader” on Nathan Anderson’s team. He said he was sending out a written resolution.

    • January 24, 2013; I contacted Rust Consulting and spoke to Barbara. She informed me that she does not know where the information I submitted to the Independent Foreclosure Review is located or who may have that documentation. She suggested I call back in one week.

The letter states that they will not rescind the sale of my home and the WFHM considers this matter closed. Including the verbiage: “Any future correspondence received regarding this matter will not be provided an answer.”

    • January 29, 2013; I received an email response from the Arizona Attorney General stating “…the Attorney General’s office can take no further action on this matter.”

    • At this point, I became so fucking disgusted with you, Wells Fargo, and the entire bullshit political and greed motivated game, that I stopped updating this timeline from my communication notes.

    I’ve spent 5 1/2 years trying to make right an error Wells Fargo created when they offered me a loan modification (before HAMP) in late 2008. They made a mistake and continued to provide improper information that then led to compounded errors all created on their end. I shared my early experiences on the FTC web site in 2009 when they were looking for mortgage servicer feedback. I suggested a single point of contact (now required via the CFPB). I testified before a state senate committee looking to change our foreclosure laws. I’ve spent $15,000 in legal fees. I’ve made a dozen “trial payments” across three approved modifications. Each one later denied with laughable documentation. And yet, Wells has never admitted that they ever made a mistake. And that’s just amazing to me. Now, they refuse to even give me or my attorney access to all ownership documentation to prove they are the party in interest, requested via a Qualified Written Request. They say they will only do so under a subpoena. I find that incredible to believe for something that should be so accurate and easy and honest to provide, that, well, it’s grown to a much more bigger issue that has now spanned 1/10th of my life. As a business which laws in our own country allow to exist, Wells should be above board and honest, and work with individuals and communities. But when they don’t have a vested interest in those communities, it’s clear it’s more about money than people. I have also led efforts to add to the state Democratic Party platform a demand for a Special Prosecutor to look into the actions of Wall Street Banks, and deals made with our own Department of Justice to see that real justice is served, not just bought and paid for.
